ThTee High Court judges yesterday dis- agreed on the answer to the question. They were giving judgment in the Queen's Bench Divisional Court on an appeal by Vincent Martel Fagan, aged 25, of Tokyngton Avenue. Wembley, Middlesex, against his conviction by Willesden Magistrates last September of assaulting P-C. David Morris in the execution of his duty. Mr. Justice James-whose view was supported by the Lord Chief Justice, Lord Parker-held that Mr. Fagan was Guilty of assault and said his appeal must be dismissed. But Mr. Justice Bridge dis- agreed. He said he had no sym- pathy for the appellant. -But I have been unable to find any wav of regarding the facts which satisfies me that they amounted to the crime of assault ". Mr. Justice James said P.C. Morris had told Mr. Fagan to stop bv the kerb. He stopped, with a wheel on the officefs left foot The Judge said they bad been satisfied that Mr. Fagan had "knowingly, provocativdLy, and unnecessarily-.allowed the wheel to stay where it was when asked to remove it.
